Above the Law?

The United States Constitution seems to be a document meant to be used for We, the People, by a group of people “much better” than those now serving and sworn to uphold it.

I am more than puzzled by what has been done recently as a substitute for law in this nation, the planet’s “last best hope.”

I refer to the total misdirection of the Blagojevich news topic arrest, and its viral meme-like spread. I am appalled by the seeming “crocodile tears” innocence of Congressional Leadership in threatening to deny legal process or seating to a solid appointment by a sitting governor – despite this governor’s being or not being a crook. Far from the founders intent, Congress is pretending to be above the very Law constraining it, but which it chooses not to follow.

On 12 December 2008, I posted the following to the visions part of the change.gov website:

--“The most important news of the day (12-09-2008) was not the arrest of Rod Blagojevich. The most important news was the promise by Barack Obama that his administration would attack Anthropogenic Global Warming.

This promise of real change was “ignored” by every major network, even PBS’s Jim Lehrer. Since Gore’s visit with Obama was known at least a few days in advance – it seems nearly a convenient contrivance to auspiciously arrest a crooked or questionable governor to spin the news and blot out the Obama commitment of his Administration to address this most important of all tasks humanity faces –specifically survival. Was this news juxtaposition a coincidence or an orchestration? I think it is an overt move based on covert motives. It seems almost a clever sleight of some “invisible” hand, to spin the “news.”

It would be somewhat surprising to find that Patrick Fitzgerald was acting at the behest of Attorney General Mukasey, who was acting on behalf of fossil energy interests. I prefer to think of Fitzgerald as the reincarnation of Elliot Ness, and an incorruptible force of nature that himself would be perfect for appointment to Obama’s vacant senatorial seat. Except, that the taint of the grand old institution (Senate) would offend all who smelled it for what it is. I’m sorry, but it often reeks. Maybe it is its collective odor, or the feeling of ooze? I know a few good men and women that serve and have served there. And so do you..

Blagojevich has not yet been indicted (!) and I question how the President-elect, or his team, can have formed an opinion as to his guilt, fitness to serve in a position to which he was elected, or interfere with the US Constitution, which directs a sitting governor's duty to appoint a replacement Senator or Congressman. Yes, a Senator can be expelled by his peers. But there ought to be a real justification rising out of the actions of the appointed one.

If we wanted to "fix" the problems that have evolved because of our strong central government, located conveniently in one city for targeting by every “monied” interest, we could easily fix and recapture the government of, by, and for the people. Except . . . there is so much money to help Congress to prevent the recapture of the government by the people.

Article V describes the process, and in the Federalist’s papers, written by the author of Article V, himself, Alexander Hamilton, stresses the peremptory nature of Article V – describing that it is beyond choice for the Congress. Yes, all 50 States have requested an amendatory constitutional convention. This is a legitimate calling.

In recent years, even the U S Court has denied the structural pre-eminence of the Constitution, and we have possibly moved so far away from the founders intent – that using the system we have, we probably can not recover the nation. Of course, all Senators, Congressmen, and Court Jurists have violated their oaths. To some, this is 5-to 20-year federal offense. I was once told this was a “contentious” issue, and when brought tangentially before the national committee, told this had likely “unintended consequences.” I take issue with that statement. Now that the Democrats rule the Congress, and the Executive, and may be able to correct the Court – will the officials “we the people” elect behave and look to the national interests? [We have the choice of a quiet lawful and peaceful revolution under the structural law of the constitution’s Article V, or the destructive option of hot bloody sectional and partisan disintegration of the world’s last best hope. I fear we are closer to that dissolve than to the resolve of law.]

Yes, when George W Bush and Chaney flaunt the Constitution and abuse it pretentiously in the name of national security, or steal from America’s present and future – we, the people should be outraged and seek reparations. But the “Club” and the “grand old institution” in Washington seems more self-interested than doing the work we need to save nation and species. We have serious issues. One is to do a much better job of providing for people trapped in this quagmire of Washington’s making with the idea of profit and usury. Usury needs changing. As population growth reaches zero and either stabilizes or reverses, we will not be able to make profit from mere population growth and instruments of greed. [The “growth” by which “profit” can be made must occur in knowledge (science) and the wisdom attendant to understanding how the universe works – a clear grasp of God’s Laws as written into the fabric of matter, energy, space, and time; indeed written into the very rock of Earth in bones and fossils. That is: God’s Laws Written in Stone.]

I believe the people of Illinois elected the Governor of Illinois. Let the people of Illinois, through the vote, or the US Attorney through the real evidence and the law, convince a jury of peers that unethical or dishonest or criminal behavior has occurred. Let the law be used as it is meant to be, and your credibility and value to the nation might be enhanced. There is no example better than letting the process of law take place; aren’t we a nation of civil law?

The Senate and House leadership is certainly of “disputable character and value” when “trial by media” and innuendo without more than boisterous words of a deal for the senate seat by the governor is all that is had – shame on them. Please convince others of the value of following the law. Reid should not pretend to adhere to the law, then interfere with it. I like the Seventeenth Amendment. Just because daylight struck Blagojevich, should the light be shown on all? Just because he is not liked by the current clique, tough – if he had appointed himself to the Senate would that be enough? Convicted Stevens got applause on the floor of that Grand Old Club, as though he had Senate support. Not good.

A simple statement to follow the clear intent of the law and the constitution would be easy.

Team playing in the Senate? Republican obstructionism will continue. Lieberman will have to help prevent Republican efforts to filibuster, and movement on stimulus will not be a single package as the package is likely insufficient to counter the fiscal greed condoned by the “conservative” Republicans through their various minions and mechanisms. A new Buckminster Fuller challenge approach to Making the World Work for 100% of us, exploiting none, and caring for the environment – can overwhelm those that profess to believe conservative greed is really our better nature.

Again, the attack on Anthropogenic Global Warming will achieve the dual purpose of recovering our economy and securing our future. Yes, We Can.
