California's Proposition 8 Passes

The fate of gay marriage in California is up in the air as Proposition 8, the ballot measure to ban the practice, is leading in the voting on Tuesday.

The California Supreme Court sanctioned same-sex marriage in the Golden State just six months ago, but voters were voting yes on Proposition 8 by a count of 53.6 percent to 46.4 percent early Wednesday morning.

Proposition 8 contains just 14 words: "Only marriage between a man and a woman is valid and recognized in California."

I report, you decide

I'm just reporting the story of the vote... I've made no comment on the proposition itself. Yes, the people have spoken... for now. There will be numerous lawsuits, and the matter will probably go back and forth. The lawyers in California must love the whole concept of propositions... it's a full employment policy for attorneys.

It's lawyer time

This is going to get uglier before it is resolved, that's for sure. If the signs I saw church folk carrying on the sidewalks in San Luis Obispo before the election are any indication, there was a lot of voter ignorance backing those who voted "yes" because the churches were saying that it would destroy freedom of speech in California. It's officially passed... I've updated the blurb with a news story and the exit poll data from the Sac Bee.

We don't need levees in California

Booming market for lawyers

Sounds like being a lawyer in California is a recession-proof job.

The outcome might be moot anyway

There have been other Propositions that have been passed by the voters of California that were ultimately overturned by a judge. The last one was about taking all benefits (except emergency services) away from illegal aliens. It passed with a large majority, but it only took one activist judge to shoot it down and, although California law allowed for the governor (Gray Davis) to sign off on it and it would become law, he didn't do it. Regardless of what happens with Prop 8, it will be a subject of litigation for months to come. No doubt there are attorneys with the court forms already printed out just waiting.
