Is this resturant discriminating against some people??

I posted this on another forum but thought I would see what kind of feedback this one would give.

A couple months back I went to town with my daughter and we did some shopping and hit some cool yard sales. Then we decided to go get something to eat before we went home. We were already 2/3rds of the way home and in Mead. Stopped at the post office and got the mail and we decided to go to Zip's which is burger chain here in the Spokane, Washington and Couer de Alene, Idaho area. Maybe they have them elsewhere too I don't know. We had a friend of my daughter's with us too that we had picked up half way through the day. She was coming to spend the night. When we got to the resturant I had to use the bathroom and so the girls went ahead and ordered. I came out and looked at the menu.

There was not ONE thing on the menu I could have. Nothing at all. All saturated fat stuff, not a salad or anything. I am on a doctor ordered diet and have been doing pretty well. On a plateu right now. They did not even have anything I could drink. I cannot have soda or coffee. Well they did have water but whoopie I can get that anywhere why should I pay them seventy five cents for it. So I sat there while the girls ate and they felt bad because there was NOTHING at all on their menu I could have. I thought surely they would have a salad at least. All the other chain resturants in the area which were five to seven miles back the other way all have low carb and low cal menu's. Carl Jr.s, McDonald's, Jack n the Box, Wendy's, Burger King. But we were already way past them. This was the only resturant left before heading home and like I said the girls had already ordered and paid for their food.

The girls felt bad that there was nothing and were very surprised because all the other resturants in town have things for low cal now. They have had for at least two years, so I had every reason to expect Zip's to have a similar menu. I asked why and they said well we have the middle school right across the road and don't want to upset them. Hello. have they not been listening to the news and how they are trying to get chain resturants to have healthier menu's because of the health risks and over weight problems and especially in the kids? I felt like I was a second class citizen and that I did not matter. They were nasty about it too. They said well we reserve the right to not serve people it is right on our door, and yes it is. But that is plain discrimination they know other resturants in the area have been changing their menus to accomodate those of us who have dietary restrictions of one sort or another.

I told them so and my daughter and her friend told them none of us would be back. I also told them I am filing a complaint with the BBB and the Consumer affairs. It would not hurt them to add a salad and a couple of other low cal or low carb items. I am sure I am not the only one who has felt this way.

They tried to say well we have this Salad Burger yeah with 1000 island dressing which is a big no no for me. They had no substitution I could have either and they would not sell it less without the dressing, Like I want to eat it dry anyway.

So maybe I should sue them for discrimination for half a million dollars, after all if some dufus can sue and win for him spilling hot coffee on himself which BTW I thought was really lame and stupid because duh you ordered hot coffee so why was it the resturant's fault you spilled in on yourself.

In my case it is blatant discrimination and disrespect of people who come in who are on diets, self imposed or doctor restricted and with the big push on the news the last couple of years to have Americans eat healtier most resturants are offering items even in burger chains for just that reason. It spoiled our luncheon and the girls felt bad because we had planned to have a nice outing.

We didn't know this resturant had literally nothing to offer dieter's or have other dietary food restrictions. I suppose we could have gone back seven miles to town, But I was tired and hungry and didn't feel like driving out of my way again. So am I being unreasonable and unfair or over acting or do you think I have a valid complaint? I personally feel like I should turn them in like I said to the BBB and the Consumer affairs. I probably would not sue though but hmmmmmmm LOL maybe. I do have a son who is an attorney.

I could understand if no one else had low cal menu but about every other chain resturant in the area does and many of the non chains as well. So I sat and watched the girls eat and talked and then we came home.

Pretty much all other resturants offer food for people like myself who are on restrictions. I don't expect of course a smorgasboard to have hamburger and fries though I have heard of some that do. I just expected the chain burger resturant to have done what all the others have and at least add a couple of items to their menu for low cal or some sort of dietary items. So was really shocked they had not.

Not Discrimination

Wagen Load Productions I have food allergies, plus being lactose intolerant. Living in a major, major metropolitan area in Arizona, I can tell you that I have many, many restaurant choices. I am sorry that your rural area didn't offer much, but I have learned either to not eat out, bring food, and bottled water into the restaurant with me to eat/drink with friends, or choose the restaurant carefully. Since we have so many restaurants, the ones that don't meet consumer needs do not get patrons, and soon go out of business. This is free enterprise in action. Suing is not necessary. Oh, and not one restaurant has ever complained about me eating/drinking my own food/drink with my friends, while my friends ordered something else. I just tell them I'm on a restricted food allergy diet. And since I'm lactose intolerant, I don't frequent Italian restaurants because I know everything on the menu contains dairy. And I've learned to stop feeling sorry for myself, other people have much more serious health issues to deal with.

Menu discrimination?...No!

As stated by the other posters, no it is not discrimination against you. However, it may offend your discriminating palate. Why can they do this? I refer you to the following documents: 1. United States Constitution and Bill of Rights 2. United States Declaration of Independence 3. Your state constitution. Most disagreements and injustices can be sorted out by perusing them regularly. Although, I do not recall any special sections on gastronomic affairs. No offense intended. We are all entitled to an opinion.

Was this restaurant discriminating? Well, sure - by definition. But not against you. They are discriminating against the more "healthy" foods. I find a few things interesting about this situation. First of all, if you are so worried about your diet, why even bother going to any fast-food restaurant. None of them have "healthy" food, just healthier food...compared to the rest of their menu. Why should Zip's cater to your needs when it has been established that they are a greasy burger-and-fries joint? Secondly, your understanding of our supposedly free-market, capitalist society seems to be severely flawed. Just because every other restaurant decided to give in to the people who whine and complain about their fat and unhealthy kids doesn't mean that Zip's has to do it as well. In fact, I wish there was a Zip's here in Florida. These idiots that file complaints and ask for legislation to mandate what restaurants can serve really have no clue about what our government's responsibilities are. Why the hell can't I go to McDonald's and get super-sized fries anymore? Because parents apparently don't know how to parent and the government loves telling businesses how to operate. "So am I being unreasonable and unfair or over acting or do you think I have a valid complaint?" I think you are being completely irrational. You do not have a valid complaint at all. And any lawyer that can make a case out of this and actually get that case heard by a judge, should be disbarred for life...and the judge should be removed from his seat. It's great that you're on a diet, and it's great that some parents don't want their kids eating unhealthy food. But your choice is to not go to these restaurants, or go and eat what they are serving. You don't go to Greasy Pete's Pig Roast and ask for a garden salad. If you do, they should have every right to kick you out the door. It's not up to you or the government to tell them what they ought to have on their menu. If you want control over a restaurant's menu, open up your own.

I mean this in a nice way, so please don't take it otherwise...

It is their restaurant, so they get to decide what is on the menu. Your choice in the matter is deciding whether you want to eat there or not. In a perfect world, yes, they would be in a position to take into account every individual customer's dietary needs, but they deal with the general public and must make business decisions based on what the majority of their targeted customer base would prefer. No, Not Discrimination

I am so sorry you had such a frustrating experience, but I dont think the restaurant was discriminating against anyone. As a mother of children with food allergies, I can tell you that we have been in the situation many times where a restaurant has nothing to offer our family. For example, I cannot eat MSG. That means that many Chinese restaurants have nothing for me to eat. And the only thing I have found at KFC to consume is a biscuit. Even the butter flavored sauce on the corn has MSG... I have a friend who is a vegetarian and who finds nothing to eat at BarBQ places... I have other friends who eat only organic food and who find little to eat at most restaurants. Many grocery stores dont offer Kosher or Halal fresh meats. Restaurants offer the food that they offer. Failure to offer choices for those with special dietary needs is not discrimination....it may be short sighted of the establishment, but it is not discriminatory. You might think of strategies that will let you dine with friends at places that don't have clear low calorie choices. For example, you might order a diet soda and a burger with out the high calorie sauces and condiments and only eat the salad items that garnish the burger and the meat pattie and drink the diet soda. Also, the calorie count on most of the salad items offered at most fast food restaurants is shockingly high, in many cases higher than the burger or sandwich offering. Just because it is a "salad" offering does not mean it is low cal. You might also want to plan ahead for meals out to make sure you will patronize an establishment that will have something to offer you that will meet your needs. Godspeed Angel
