Josie Smith Malave Victim of an Anti Gay Hate Crime

The top chef from season 2, Josie Smith Malave, was spit on and attacked by people with anti gay beliefs. Josie is openly gay. There is more on the brief and unfortunate attack story at the link.

There's the rub...

I am straight, but that is not how I see myself. I see myself as just a guy. Gays, because of choices they make, see themselves as gay first, so any assault upon their person is an assault upon their "gayness", making any assault an automatic "hate crime". _______________________________________________________ "Treason doth never prosper, what's the reason? When it happens (and yes it happens), it's not something that gets national media attention, so most people would not learn about it. My point was she was assaulted and spat upon, yes, but to lead with "hate crime" is trying to sensationalize something before all the facts are known, playing to people's emotions rather than intellect. _______________________________________________________ "Treason doth never prosper, what's the reason? Re: Question

If a gay person attacked a straight person specifically because he was straight, yes, that would be a hate crime.

I don't think that happens

I don't think that happens enough to be considered a hate crime. This is just one of those common sense things I guess.

Question:

If a gay person were to spit on and attack a straight person, would that be a "hate crime", too? If not, then "hate crime" legislation violates the equal protection clause of the Constitution. _______________________________________________________ "Treason doth never prosper, what's the reason?
