have to know the name of the person or
business that you're suing.
you have to know their full name and their address and contact number. You have to use all these personal information to fill out on the suing application and in order to serve them. If you don't know who they are or their address or full name then who will you sue? Therefore when you encounter a problem, it's wise to gather all of this information or save the documents that they gave you.
Next up is gathering your evidence. In order to win a case in court you have to have legal documents. You have to have written or physical evidence. Word of mouth is meaningless in court. You can say a thousand things but the judge won't make sense of any of it. This is not how the court works. You should know that by now because it's basic information. Any receipts, contract, written statements, phone calls, phone record, credit card record, bank statements, blood, finger prints, you need to save it and show it in court in order to have a strong standing in your case.
Next is going to court to file an application for small claims court or going to a lawyer's office to get an attorney. You can go to small claim court if it's under 5k but if it's over that you need to get the help of a lawyer. You can get a consultation with your lawyer. If they will take the case then you will know but sometimes they won't take your case because of their policy. They won't take your case if you have consulted the wrong type of lawyer that don't deal with your particular issue.
Every lawyer has their specialty and you need to go to the specific ones that deal with your issue. If you have a losing case or a weak case with not a lot of evidence then they won't take your case either. There could be so many reasons why they won't take your case.
Next you will wait for the court date and show up to court. If you don't show up you may delay the case for another couple of months to years. The court is a very busy place and they don't wait for you. You will be waiting for them. I have come across many red tapes and you will be
waiting for a long time and it's just not worth it.
When you show up to court be prepared to make your statement or act in accordance with your lawyer's advice.
You should do research on your case as much as possible, like similar past ruling to know about it. You should also learn the do's and don't of making statement if you'll be on your own in small claims court. After you have gone to court you'll be waiting for your judgment at home. The verdict is mailed sometimes and sometimes it's in court.
