Letter to the RNC Regarding Obama Eligibility

I'm sure most people will claim that this issue is nothing but an internet conspiracy theory, but Barack Obama's presidential eligibility has yet to be determined, despite all of the contrary claims by the gravely misinformed. The following is a letter that was sent off to the Republican National Committee today by yours truly. Please read it with the understanding that I am not a conspiracy theorist and have a very well-reasoned and researched article to support my opinions contained therein.

"To the RNC Chairman, Co-Chairman, and Counsel:

"Good morning/afternoon/evening. Please forgive my curtness in this letter and the absence of a proper introduction. I have reached a point of great concern for my country and for the government that allegedly represents me and protects my rights and prosperity.

"For several months there have been legal challenges regarding the eligibility of President-elect, Barack H. Obama – in particular, the question of natural born citizenship. These challenges have been met with contempt by Mr. Obama, most of the media, members of Congress (from both parties, regrettably), and even some justices in our federal courts. To date, not one government entity – local, state, or federal – has publicly provided definitive evidence that the eligibility of Mr. Obama for the Office of the President of the United States is legitimate. With just a couple of days remaining before he is sworn in as our 44th president, the time for clear and decisive action is now.

"I know that natural born citizenship is not defined in the Constitution. Since it is not defined, intent and construction must be derived from other sources. The sources that the Founding Fathers used to create our form of government and its laws are well-known. Most, if not all of these sources are found in our very own Library of Congress. It is of the utmost importance that the intent of our Founders is properly interpreted when reading our Constitution and there should be no exceptions whatsoever, especially concerning a position as vital as the federal executive.

"I realize that our federal representatives find themselves in a peculiar position in relation to their constituents and the public in general. I also realize the significance that this past presidential election has had on our country. But it should not be a matter of political correctness or a threat of potential racial angst or hostility that prevents us from upholding and adhering to our laws as written. In my opinion, Barack H. Obama’s eligibility for the presidency is not clearly legitimate according to the language of our Constitution and the intent of the Founders and later generations of lawmakers and justices.

"I have reached the foregoing conclusion based on the writings of those whom the founding generation studied industriously. Among these writers were Emerich de Vattel, Jean Jacques Burlamaqui, Hugo Grotius, Thomas Hobbes, Samuel Pufendorf, and Jean Bodin. These brilliant publicists shaped the philosophies of many of our Founding Fathers and their writings are reflected in many of our founding documents, including our Constitution. Specifically, citizenship – and even natural born citizenship – has been defined in the works of these legal scholars and philosophers. When trying to determine intent of our laws, they certainly are invaluable.

"Beyond the years of our Founders, there is a plethora of congressional records that give us a definition of citizenship – a citizenship that was extensively debated in Congress prior to the Civil Rights Act of 1866 and the 14th Amendment. These debates are also crucial in deciding what the phrases “not subject to any foreign Power” and “subject to the jurisdiction thereof” mean. The latter phrase is still used in the United States Codes today. Surely the government must know what the phrase means in its original context, since the definition is a matter of congressional record (which can be found in the Congressional Globe).

"The question of citizenship and eligibility – particularly natural born citizenship – rarely finds itself before the courts and at the forefront of federal politics. This is a rare occasion where the question has arisen and the effects could be potentially devastating no matter what the outcome. In this situation, I believe it is better to arrive at a correct decision rather than travel the path with the least resistance. Mr. Obama, while I’m sure his intent is not to utterly destroy this country, has put himself in a unique position that will set him up for repeated legal challenges from the general public and possible impotence as the Commander-in-Chief of our military. It is an avoidable disaster which he has refused to address to this day. His rejection of legal inquiries and adamant refusal to disclose important documentation that can resolve this issue has merely prolonged the debate and is on the verge of setting this country up for a potential catastrophe in our federal government. It is because of this that I have written you today.

"I was born of two citizen parents in the State of Ohio. I have never lived or worked in another country and I have never renounced my citizenship. I have served in the United States Air Force and was honorably discharged. I currently reside in Florida and dutifully pay my taxes and actively participate in the political process. I am asking as a citizen, a patriot, and a producer of society, that anyone with the capacity to find answers to the questions that have been raised, find those answers and disseminate it to the public as quickly as possible. I do not want to hear pre-packaged responses from our representatives or our political parties. I do not want to hear that Mr. Obama’s eligibility has already been verified – unless you can direct me to the proper government investigation, inquiry, or documents that have definitively answered and explained the questions that have been raised. If there are none, then I would expect that an investigation or inquiry shall start immediately in order to avoid future calamities.

"If you cannot provide information that should already exist or if you insist on responding with false information or an unwillingness to investigate the matter, you can expect me to withdraw any and all support that I may offer to the Republican Party now and in the future. I will not vote for any Republican in state or federal elections and I will not donate one penny of my income to any Republican candidate or Republican-sponsored event. I’m sure you receive many threats from people claiming they will leave the Party if you do not act, but rest assured that this is no idle remark without any intent to follow through. The actions of the Party as a whole have been near disgraceful over the past few years and this situation is not a matter that can be swept under the rug and completely dismissed. Our Constitution, and potentially our way of life, is in jeopardy. I trust that you understand the gravity of this moment and do not take constitutional matters like this lightly.

"I thank you for your time and will be expecting a response that is appropriate to the seriousness of this letter."

Of course, this letter contained my name and contact information as well, but since my readers are not yet privileged to know that information, it has been withheld from this post.

Some of you may be wondering what my aim is by demanding answers about Obama's citizenship and eligibility status. It's simple: the constitution was written with specific requirements that had specific meanings. If Obama does not meet those basic requirements, he is ineligible to hold the office he has been elected to. Without a constitutional amendment that repeals the requirement in question - "natural born citizenship" - there is no remedy to the situation if Obama is indeed ineligible.

The longer we wait to find the answers to this query, the more potential danger there is to the stability of our federal government. All I am seeking is an answer to a simple question. I'm not sure why this question is continually met with so much resistance. It certainly makes one wonder...

Let me write this AGAIN...hoping that everyone will comprehend it: The Birth Certificate is irrelevant in this situation. It will not determine whether or not Obama is a natural born citizen. We already know that he was born a British citizen through his father. He admitted this himself. Furthermore, even though this is irrelevant, Hawaii NEVER confirmed that Obama's birth certificate proves he was born in Hawaii - they simply said a certificate is on record. But what bothers me more is the fact that you seem to think the Constitution isn't an important matter. Let me just put it this way: if the presidency is no longer subject to the laws that we the People have adopted and given our consent to, then why should we adhere to those laws? The People adopted the eligibility requirements for the presidency. We ought to be able to enforce those requirements...or at least have the courts or Congress explain to us why they are not being applied or - at minimum - inquired about. At worst, Obama is a usurper, and every single law or treaty he signs would be void. You're worried about our current "crisis"? Imagine what kind of crisis that would create. John McCain is irrelevant now, but I do think it would have been a fair question to ask for a judgment on him as well - I just don't believe his situation was comparable and the laws of citizenship as written and understood by past and present generations would have most likely confirmed his status. Publius, I admire your style and your eloquence however President Obama's birth certificate, which was from Hawaii where he was born, was validated by the department of records in Hawaii. I'm pretty sure that Hawaii is a U.S. state. If we want to get really picky, his former rival, John McCain was not born in the U.S. but in Panama. The claim that the U.S. had to a small strip of land there, that was later returned to Panama and is no longer considered a U.S. territory, is dubious. There is so much else to worry about in this time of crisis. Really. Write Articles Like This And Earn $$

IDEA of your ability to construct a logical and totally irrelevant argument. We all know that Florida corruption and the daddy-appointed US Supreme court selected Bush -- even when the states could have ordered a recount. We know the Bush lost the Florida vote. Gee whiz pub, should the last eight years have happened? No. When the truth is written, it will be clear that this last presidency was the worst time of the United States of America. The damage done has multi-generational consequences -- and will turn out to be the most damaging administration in history -- and because of energy and man-made global warming -- the cause of more deaths than Hitler. This is kind of like accepting the NY Times story that Caroline Kennedy has withdrawn her interest in taking the seat Hillary Clinton vacated in the Senate. Without verification? That story was denied by Caroline Kennedy's family and should have ended what could be a vicious rumor. Of course, that is the kind of story you seem ready to tackle, saying yeah, "she withdrew" it was in the Times . . . This AM even her cousin Robt F. Kennedy Jr said he did not know and had tried to Call Caroline last night and this morning. I hope she stands in front of a mike and says yea or nay. (The latest stuff says she has pulled out of contention; yet I want to hear her say it. You know?) But the citizenship or eligibility of a sitting President might be hard to press. Write about what happens when UN and Interpol converge and present credentials to the Secret Service to escort Bush to New York to address the UN about the torture? Or something creative, like when DOJ with US Marshalls meet with the Secret Service to escort Chaney and Bush to a federal court. . ? you know, some creative work. I can't imagine Bush having damaged this nation as much as he has damaged it and getting clean away with it. Your judgment to support his work and such as Chaney and Libby and the Republican Party -- and Palin? This shows judgment, don't it now? Good luck. Let this one go. You need to spend more time working to get Bush prosecuted for his war crimes. If you served in Iraq you unwittingly, because Bush lied about WMD, took part in the war crime yourself. Idle... The Donofrio case

Idle... The Donofrio case was dismissed before the Electoral votes were certified. The State of Hawaii said they have a birth certificate on record. They did not say whether the certificate proves Obama's location at birth. But again, it is not important to the "natural born" question. The courts have not made any decision based on the "validity" of the arguments in the cases. They have dismissed them almost exclusively on the issue of standing. I wrote to the RNC, my representative in the House, and one of my Senators. I wrote to them because they have the ability to take this question to Congress, where I believe the matter needs to be debated and settled in the proper government body and in the proper forum. The courts are only a last remedy for a redress of grievances. If there is no traction in Congress by those who represent us, then it will do me little good to send a letter to a department (like the Justice) that is now under the control of an Obama administration. U.S. Supreme Court turns down Obama citizenship case

The vote has now been certified, and the Supreme Court has since then denied a request on such a case. From a recent article in the Wall Street Journal's Law Blog... " Justice Thomas picked up the petition to hear a lawsuit filed by New Jersey attorney Leo Donofrio after it was denied by Justice Souter. Justice Thomas referred it to the full court, which decided to distribute the case for the justices’ conference....SCOTUSblog reports that the Court denied Donofrio’s request. SCOTUSblog notes that this marks the second time in recent weeks that the Court turned aside such a challenge." Considering that a number of state cases have also failed, I'm thinking there isn't really much to these cases. Some people claim Obama wasn't born in Hawaii; apparently Donofrio admits that he *was* born there. The State of Hawaii has verified that it has Obama's birth certificate and it is legitimate. I agree that *if* Obama *wasn't* a citizen that would be a thorny issue, but I don't see that any of these claims have validity, and it seems not once have courts accepted these cases. If you're really concerned about this issue, I'm not sure why you're writing to the RNC instead of a government body that would have some jurisdiction over matters like this. I would think that the RNC has already looked into this matter and pursued if they thought it was something that really needed to be pursued.
