19- YOU WHO BELIEVE, IT IS NOT PERMITTED FOR YOU TO INHERIT WOMEN AGAINST THEIR OWN WILL, NOR IS IT PERMITTED FOR YOU TO HURT THEM IN ORDER FOR YOU TO TAKE PART OF WHAT YOU HAVE GIVEN THEM, UNLESS THEY
COMMIT A MANIFEST SIN. AND LIVE WITH THEM KINDLY, BUT IF YOU HATE THEM, MAY BE YOU HATE SOMETHING IN WHICH ALLAH PUTS A GREAT DEAL OF GOODNESS.
Women used to be inherited themselves as part of the man’s estate; their deceased husband’s family had a right to marry them against their will. In the mean time, they did not inherit from their husbands. Abd Allah Ibn Abas reported: “What used to happen (before Islam) is whenever a man dies, his close kin had a right to his wife, if one of them wishes he could marry her; and if they wish they let her marry someone else, and if they wish, they do not let her marry. They have more right for her than her own family, until this Ayah was sent down”. (B: Tafseer Sorah 4,6 & D:Nekah;22)
With this Ayah, Allah the Highest gives their rights as human beings back. They should not be treated like goods and chattels. They have every right to decide what they want to do with themselves and whom to marry, if the event of their husbands death.
“NOR IS IT PERMITTED FOR YOU TO HURT THEM IN ORDER FOR YOU TO TAKE PART OF WHAT YOU HAVE GIVEN THEM, UNLESS THEY COMMIT A MANIFEST SIN”
This is another regulation concerning the rights of the women in marriage. Allah the Highest forbids the Muslims from hurting the women and cause hem difficulties so that they woman requests divorce buying it with her dowry and possibly more.
The Husband is permitted to take the dowry back to divorce his wife if she is commits a manifest sin, like adultery, or being abusive and insulting to her husband. We should remember that Allah the Highest is watching over us and knows what is inside us, and Allah is the ultimate judge in these matters. We should be careful not to commit sin and wrong our own souls if we go against the spirit of Allah’s commands.
“AND LIVE WITH THEM KINDLY”
Living with them kindly is not just giving them their rights or cloth and food etc. it is more. It is the care and compassion between them, the kind and pleasant words and deeds. Allah the Highest said about husbands and wives being garments to each other saying: “YOU ARE GARMENTS FOR THEM AND THEY ARE GARMENTS FOR YOU”. (S:2 A:187)
And said: “AND OF HIS SIGNS IS THAT HE CREATED FOR YOU, FROM YOURSELVES PARTNERS TO SETTLE TO, AND MADE THERE LOVE AND COMPASSION BETWEEN YOU”. (S:30 A:21)
Allah’s messenger prayer and peace upon him is our example, as Allah the Highest said: “YOU HAVE AND EXCELLENT EXAMPLE IN ALLAH’S MESSENGER”. (S: 33 A:21)
Allah’s messenger prayer and peace upon him said: “The best of you is the best to his wives and I am the best you to my wives”. (Ma:Nekah;50 & Da:Nekah;55)
“BUT IF YOU HATE THEM, MAY BE YOU HATE SOMETHING IN WHICH ALLAH PUTS A GREAT DEAL OF GOODNESS”
A husband and also the wife should look at each other objectively if they dislike something in the other person. Should look at their other good points and the positive aspects of their character, to see if they are really as bad as one thinks. Allah’s messenger prayer and peace upon him said: “Let no believing man hates a believing woman, should he hate on of her characters, he will like another”. (M:Redaa;63 & A:2;329)
We should also remember that although is permitted in Islam, Allah the Highest hates it. Therefore divorce should be the very last resort, to be used only when all else fails. Allah’s messenger prayer and peace upon him said: “The most hated to Allah of what is halal is divorce”. (D:Talaq;3 & Ma:Talaq;1)
